01Purpose and Scope
This Intellectual Property & Copyright Policy (“Policy”) governs intellectual-property rights associated with Famepify, including copyright, trademarks, brand assets, website content, software, databases, documentation, user-submitted material, infringement complaints, takedown requests, counter-notices and related enforcement procedures.
Famepify is operated under Famepify Media.
This Policy applies to:
- visitors to Famepify websites;
- registered Users;
- customers;
- API users;
- resellers;
- agencies;
- content contributors;
- persons submitting material through Famepify;
- persons asserting intellectual-property rights against material available through Famepify; and
- other persons interacting with intellectual property associated with the Platform.
This Policy forms part of the wider Famepify legal framework and shall be read together with the:
- Terms of Service;
- Acceptable Use Policy;
- Privacy Policy;
- Complaints & Dispute Resolution Policy; and
- API & Reseller Terms.
Nothing in this Policy shall be interpreted as creating ownership rights that do not exist under applicable law or as limiting a copyright exception, defence, licence or other lawful use that cannot validly be restricted.
02Applicable Intellectual Property Framework
Nigerian Copyright Law
Copyright matters concerning Famepify are governed principally by the Copyright Act 2022 of the Federal Republic of Nigeria, together with applicable regulations, judicial decisions and requirements of the Nigerian Copyright Commission.
The Copyright Act protects eligible categories of works including literary, musical, artistic and audiovisual works, sound recordings and broadcasts, subject to the conditions and limitations contained in the Act.
Eligibility for copyright protection under Nigerian law does not depend upon registration as a condition of copyright subsistence.
Registration may nevertheless provide evidential or administrative benefits where applicable.
Trade Mark and Related Rights
Trade marks, brand names, logos and other source-identifying signs may be protected under applicable Nigerian trade mark law, passing-off principles, unfair competition rules and other applicable laws.
A statement in this Policy identifying material as a Famepify mark shall not be interpreted as representing that every such mark is registered in every jurisdiction.
Rights may arise from:
- registration;
- pending registration;
- statutory protection;
- goodwill;
- reputation;
- passing-off principles; or
- other applicable legal rights.
International Rights
Copyright, trade mark and other intellectual-property rights may also arise under the laws of jurisdictions outside Nigeria.
Where an international right is asserted against activity occurring through Famepify, applicability shall depend upon the territorial scope of the relevant law and the circumstances of the activity.

The inclusion of material in this list does not constitute a representation that every item appearing through Famepify was originally created by Famepify.
Some material may be lawfully licensed, supplied by third parties, subject to open-source licensing or otherwise used under rights belonging to another party.
No Transfer Through Platform Use
Accessing or using Famepify does not transfer ownership of Platform Content or any associated Intellectual Property Rights to the User.
Except where expressly stated, payment for a Famepify Service constitutes payment for the applicable Service and does not purchase the underlying Famepify:
- software;
- Platform design;
- source code;
- database;
- Brand Assets;
- documentation;
- business systems; or
- other proprietary material.
05Copyright Ownership
Ownership Depends on Applicable Law and Agreement
Copyright ownership shall be determined according to applicable law and any valid agreement governing the relevant work.
Famepify shall not claim ownership of a work merely because the work appears on, passes through or is referenced by the Platform.
Works Created for Famepify
Where Content is created for Famepify by:
- employees;
- contractors;
- freelancers;
- agencies;
- photographers;
- designers;
- developers;
- writers; or
- other contributors,
- the ownership, assignment or licensing of copyright shall be determined according to the applicable agreement and law.
Famepify’s rights in commissioned or externally produced Content shall therefore extend only as far as the applicable contract or law provides.
Assignments and Licences
Where copyright has been validly assigned or licensed to Famepify, Famepify may exercise the rights falling within the scope of that assignment or licence.
Nothing in this Policy shall enlarge an assignment or licence beyond its actual terms.
06Moral Rights
Author Rights
Applicable copyright law may recognise moral rights or comparable personal rights of authors, including rights associated with authorship and treatment of a work.
Famepify’s ownership of economic rights, where applicable, shall not be interpreted as eliminating a moral right that applicable law preserves independently.
Attribution and Integrity
Where attribution or integrity rights apply, Famepify shall respect those rights to the extent required by law and any applicable agreement.
07Copyright Registration
Copyright Does Not Depend on Registration
Copyright protection under Nigerian law may arise without registration where statutory requirements for protection are otherwise satisfied.
Accordingly, failure to produce a copyright registration certificate shall not, by itself, prove that copyright does not exist.
Registration Evidence
Where a work has been registered with the Nigerian Copyright Commission or another competent authority, registration information may be relevant evidence in an intellectual-property dispute.
Famepify may request such information where reasonably useful to verify a claim.
08Famepify Brand Assets
Protected Brand Elements
Brand Assets associated with Famepify and Famepify Media may include, as applicable:
- Famepify;
- Famepify logos;
- Famepify-related product and service names;
- distinctive design elements;
- icons;
- graphical representations;
- visual identity;
- slogans;
- trade dress; and
- other source-identifying Brand Assets.
No statement in this Policy constitutes a representation that every Brand Asset is registered as a trade mark.
No Implied Trade Mark Licence
Use of Famepify does not grant a general licence to use Famepify Brand Assets.
Unless otherwise permitted by law or expressly authorised, no person may use a Famepify Brand Asset in a manner that:
- falsely suggests affiliation;
- falsely suggests endorsement;
- misrepresents official status;
- creates a deceptive imitation;
- impersonates Famepify;
- misleads customers about the source of a service;
- passes off another business as Famepify; or
- otherwise infringes applicable trade mark or passing-off rights.
09Permitted References to Famepify
Truthful Descriptive References
Nothing in this Policy prohibits truthful and lawful reference to Famepify where such reference is reasonably necessary to:
- identify Famepify;
- discuss the Platform;
- review Famepify;
- criticise Famepify;
- report news;
- identify compatibility;
- describe a genuine reseller relationship;
- link to Famepify; or
- make another lawful nominative or descriptive reference.
Such use shall not falsely imply endorsement, sponsorship, partnership or official status.
Reviews and Criticism
Famepify intellectual-property rights shall not be used as a basis for suppressing lawful:
- reviews;
- criticism;
- commentary;
- reporting;
- parody;
- satire; or
- other uses protected under applicable law.
The fact that content is unfavourable to Famepify shall not, by itself, constitute intellectual-property infringement.
10Resellers and Brand Use
No Automatic Agency Relationship
A reseller’s permission to purchase or resell Famepify Services does not make the reseller:
- Famepify;
- Famepify Media;
- an employee;
- an official branch;
- a franchisee;
- an authorised spokesperson; or
- an agent capable of binding Famepify,
- unless Famepify expressly agrees otherwise.
Reseller Use of Brand Assets
Where Famepify expressly authorises a reseller to use Brand Assets, such permission may be subject to:
- brand guidelines;
- scope limitations;
- permitted channels;
- approved descriptions;
- duration;
- revocation rights; and
- restrictions against misleading presentation.
Authorised use does not transfer ownership of the Brand Assets.
Prohibited Reseller Branding
A reseller shall not use Famepify Brand Assets to create a materially misleading impression that an independently operated website, support account, payment account or business is owned and operated by Famepify.
11Domains, Social Handles and Impersonation
Confusing or Deceptive Use
A person shall not use Famepify Brand Assets in a domain name, subdomain, social media handle, profile, application name or other identifier where the use is intended or reasonably likely to mislead persons into believing that the destination is an official Famepify property when it is not.
Fraudulent Impersonation
Use of Famepify intellectual property in connection with:
- phishing;
- fake login pages;
- fake payment pages;
- fake refund pages;
- fraudulent customer support;
- credential theft;
- false promotions; or
- other deceptive impersonation
is prohibited and may also constitute a violation of the Acceptable Use Policy.
12License to Use the Platform
Limited User Licence
Subject to compliance with the Terms of Service and applicable Policies, Famepify grants Users a limited, non-exclusive, non-transferable and revocable permission to access and use the Platform for its intended lawful purposes.
This permission does not grant ownership of Famepify Intellectual Property Rights.
Restrictions
Except where expressly authorised by Famepify or permitted by applicable law, a User shall not:
- reproduce substantial Platform Content;
- republish proprietary Platform Content;
- sell copies of Platform Content;
- create unauthorised derivative commercial products from Platform Content;
- systematically scrape proprietary Content;
- extract substantial database content;
- reverse engineer protected software except where legally permitted;
- remove copyright notices;
- remove proprietary notices;
- remove rights-management information;
- circumvent technological protection measures;
- falsely claim authorship;
- sublicense Platform Content; or
- exploit Famepify intellectual property outside the scope of permitted use.
These restrictions shall not prohibit an act that applicable law expressly permits notwithstanding contractual restriction.
13API Documentation and Developer Materials
Permitted Integration Use
Authorised API users may use Famepify API documentation, examples and related developer materials to the extent reasonably necessary to build, operate and maintain an authorised integration.
No Transfer of API Intellectual Property
API access does not transfer ownership of:
- Famepify API architecture;
- documentation;
- proprietary endpoint design;
- source code;
- databases;
- Service catalogue structure; or
- other proprietary technology.
API Data
Rights relating to information obtained through the API depend upon the nature and source of that information.
The User shall not assume that every item returned through the API is owned by Famepify or freely reusable outside the authorised integration.
14Website Content and Articles
Original Editorial Content
Original articles, guides, tutorials, descriptions and other editorial Content published by Famepify may be protected by copyright.
Publication on a publicly accessible website does not place that Content in the public domain.
Quotations and Lawful Uses
This Policy does not prohibit use permitted by applicable copyright law.
Depending upon the circumstances, lawful use may include applicable fair-dealing exceptions for purposes such as:
- private use;
- parody;
- satire;
- pastiche;
- caricature;
- non-commercial research;
- private study;
- criticism;
- review; or
- reporting current events,
- subject to the conditions and limitations imposed by applicable law.
Attribution Does Not Automatically Authorise Copying
Giving credit to Famepify does not automatically make an otherwise infringing reproduction lawful.
Likewise, absence of permission does not make a use infringing where the use is independently authorised by law.
15Linking to Famepify
Ordinary Hyperlinks
Persons may ordinarily link to publicly accessible Famepify pages provided the link:
- does not falsely imply endorsement;
- does not facilitate unlawful activity;
- does not misrepresent the destination;
- does not obscure the identity of Famepify; and
- is otherwise lawful.
Framing and Misleading Presentation
A person shall not frame, mirror or reproduce Famepify in a manner designed to make users believe that Famepify Content belongs to or is operated by another entity.
16User Content
User Retains Ownership
Famepify does not claim ownership merely because a User submits User Content through the Platform.
Subject to third-party rights and applicable law, the User retains whatever ownership rights the User lawfully possesses in User Content.
Limited Licence to Famepify
By submitting User Content where processing is necessary to provide the requested Platform function, the User grants Famepify a non-exclusive licence to:
- receive;
- host;
- store;
- reproduce as technically necessary;
- transmit;
- display where necessary;
- process;
- format; and
- otherwise use
that User Content only to the extent reasonably necessary to provide, secure, administer or support the relevant Platform function or otherwise as disclosed and lawfully authorised.
Scope of User Content Licence
The licence does not grant Famepify an unrestricted right to commercially exploit unrelated User Content merely because it was submitted through support, an Order form or another Platform function.
The licence may extend to Famepify’s service providers where their processing is reasonably necessary to perform the applicable function.
Termination of Licence
Where User Content is deleted or the applicable Account is closed, the operational licence shall cease to the extent the Content is no longer reasonably required, subject to:
- backups;
- legal obligations;
- fraud prevention;
- security;
- dispute resolution;
- payment records;
- litigation;
- preservation requirements; and
- other lawful retention grounds.
17User Representations Concerning Submitted Content
Authority to Submit Content
A User submitting Content represents that the User has an appropriate lawful basis to provide that Content to Famepify.
This may arise because:
- the User owns the Content;
- the User has permission;
- the User holds a licence;
- the submission falls within a legal exception;
- the Content is public information lawfully being supplied for the relevant purpose; or
- another lawful basis applies.
No Requirement of Exclusive Ownership
A User does not necessarily need to own copyright in every item referenced through Famepify.
For example, submitting a public social media URL for an Order does not necessarily require ownership of all copyright in the linked page.
The required authority shall depend upon the nature of the Platform function and applicable law.
Prohibited User Content
A User shall not knowingly submit Content through Famepify in circumstances where doing so unlawfully infringes another person’s Intellectual Property Rights.
18Support Attachments and Evidence
Limited Use of Submitted Evidence
Screenshots, recordings, documents and other materials supplied through support, refund, complaint or investigation procedures may be copied, stored and reviewed to the extent reasonably necessary to resolve the applicable matter.
Submission does not transfer ownership of the underlying Content to Famepify.
Third-Party Material
A User should avoid supplying unrelated copyrighted or confidential material where it is unnecessary for resolving the relevant support matter.
19Feedback and Suggestions
Voluntary Feedback
A User may voluntarily provide suggestions, ideas, comments or feedback concerning Famepify.
Unless the parties expressly agree otherwise, ordinary unsolicited feedback shall not create an obligation for Famepify to treat the underlying idea as confidential.
Pre-Existing Rights Remain Unaffected
Submitting feedback does not transfer copyright in an independently protected work beyond any permission reasonably implied or expressly granted for evaluating or using the feedback.
Nothing in this section authorises Famepify to appropriate proprietary material submitted subject to an agreed confidentiality obligation.
20Third-Party Content
Third-Party Ownership
Famepify may display, link to, process or refer to Content owned by third parties.
Such Content may include:
- social media names;
- platform logos;
- service names;
- embedded materials;
- payment-provider marks;
- supplier information;
- customer Content;
- external links; or
- other third-party material.
Rights in third-party material remain with the applicable Rights Holder.
No Transfer Through Reference
Reference to a Third-Party Platform or trade mark does not constitute a claim that Famepify owns that third-party intellectual property.
Likewise, use of a third-party name for descriptive purposes does not necessarily indicate affiliation or endorsement.
21Software and Source Code
Platform Software
Software and code used to operate Famepify may include:
- proprietary Famepify code;
- third-party commercial software;
- open-source software;
- frameworks;
- libraries;
- plugins; and
- licensed components.
The rights applicable to each component depend upon its respective licence and ownership.
Open-Source Software
Nothing in this Policy shall restrict a right granted under an applicable open-source licence.
Where an open-source licence provides rights inconsistent with a general restriction in this Policy, the applicable open-source licence governs the relevant component.
No Unauthorised Source Code Access
A person shall not obtain, distribute or exploit proprietary source code through unauthorised access.
Any reverse-engineering restriction shall apply only to the extent permitted by law.
22Databases and Compilations
Database Content
Famepify may own or control rights in original compilations, organisation, selection or arrangement of Platform data to the extent recognised by applicable law.
Such rights do not create ownership over underlying data that Famepify does not otherwise own.
Systematic Extraction
Unauthorised systematic extraction, replication or commercial republication of substantial proprietary Platform datasets may violate this Policy and applicable law.
This provision shall not prevent lawful exercise of:
- data-access rights;
- portability rights;
- fair dealing;
- authorised API access; or
- another statutory right.
23Artificial Intelligence and Machine-Assisted Content
AI-Assisted Materials
Famepify may use technological tools, including automated or machine-assisted systems, in connection with certain Content or design workflows.
The copyright status of any machine-assisted material shall be determined according to applicable law and the human authorship, contractual and other circumstances relevant to that material.
No Overstatement of Copyright
Famepify shall not rely upon this Policy to claim copyright in material where applicable law does not recognise copyright in that material.
Rights may nevertheless arise in:
- human-authored elements;
- selection and arrangement;
- editing;
- accompanying text;
- Brand Assets;
- compilations; or
- other independently protectable elements.
24Copyright Infringement
Prohibited Infringement
A User shall not knowingly use Famepify to:
- reproduce infringing material;
- distribute infringing copies;
- make unauthorised protected Content available;
- facilitate piracy;
- sell infringing copies;
- knowingly link to infringing material in circumstances giving rise to liability;
- remove rights-management information unlawfully;
- circumvent protected technological measures unlawfully; or
- otherwise infringe copyright.
Assessment Under Applicable Law
Not every unauthorised use of copyrighted material necessarily constitutes infringement.
Applicable licences, statutory exceptions, fair dealing and other defences shall be considered where relevant.
25Copyright Infringement Notices
Submission of a Notice
A Rights Holder who believes that copyright-protected Content available through a Famepify-controlled system infringes copyright may submit a written Copyright Infringement Notice to:
- legal@famepify.com
- Phone / WhatsApp
- +2349061160205
- Address
- Wuse, Abuja, Nigeria
- Suggested Subject
- Copyright Infringement Notice
A notice may be transmitted electronically.
Information Required in a Copyright Notice
To enable effective review and, where applicable, to satisfy the notice requirements under Nigerian copyright law, a notice should include:
- a physical or electronic signature of the Rights Holder or a person authorised to act on the Rights Holder’s behalf;
- identification of each copyrighted work claimed to have been infringed;
- identification of the allegedly infringing material or activity;
- sufficient information to enable Famepify to locate the material;
- sufficient contact information for the complaining party;
- a declaration on oath that the complainant believes that the complained-of use is not authorised by the copyright owner, the owner’s agent or the law; and
- a statement that the information supplied is accurate and that the complainant is authorised to act on behalf of the owner of the allegedly infringed right.
Where multiple works located in a common location are involved, sufficient identification should be provided to enable Famepify to understand the scope of the claim.
Specific Location Information
A notice should identify the exact location of the allegedly infringing material where reasonably possible.
This may include:
- URL;
- page name;
- file location;
- Account identifier;
- API location;
- screenshot;
- description of the Content; or
- another locator sufficient for identification.
A general statement that “your website infringes my copyright” may be insufficient to identify the material requiring review.
26Incomplete Copyright Notices
Requests for Additional Information
Where a notice lacks information reasonably necessary to identify:
- the Rights Holder;
- the protected work;
- the allegedly infringing material;
- the location of the material; or
- authority to act,
- Famepify may request clarification or additional information.
No Obligation to Guess the Claim
Famepify shall not be required to identify unspecified works or search the entire Platform in an attempt to determine what material a complainant may have intended to report.
This shall not prevent Famepify from taking reasonable protective action where infringement is otherwise apparent.
27Statutory Notice-and-Takedown Procedure
Application of the Copyright Act Online Content Procedure
The Copyright Act 2022 contains statutory procedures governing certain online service providers.
Where:
- Famepify qualifies as a “service provider” for purposes of the applicable provisions of the Act;
- the relevant Content falls within the statutory online-content framework; and
- a valid statutory infringement notice has been received,
- Famepify shall apply the applicable statutory procedure to the extent required by law.
Notice to the Responsible User
Where the statutory procedure applies, Famepify may provide the responsible User or subscriber with notice of the infringement claim in accordance with applicable law.
Information supplied by the complainant may therefore be disclosed to the affected User to the extent reasonably necessary or legally required to administer the infringement process.
Removal or Disabling of Access
Where required under the statutory procedure, Famepify may expeditiously:
- remove the complained-of Content; or
- disable access to the complained-of Content or link.
Removal under a statutory process does not constitute a final judicial determination that infringement occurred.
Notice to Rights Holder
Where required, Famepify may notify the Rights Holder after the relevant Content or link has been removed or disabled.
28Counter-Notices
Right to Challenge Removal
Where Content has been removed or disabled pursuant to an applicable copyright notice procedure, the affected User may submit a written counter-notice disputing the claim.
A counter-notice should identify:
- the affected Content;
- the applicable Account or location;
- the User’s full contact information;
- the factual basis upon which the User believes the removal resulted from mistake, misidentification, lawful use or another valid basis;
- relevant evidence; and
- the User’s physical or electronic signature.
Forwarding the Counter-Notice
Where the statutory procedure applies, Famepify may forward the counter-notice to the complaining Rights Holder as required by law.
The affected User should therefore understand that contact and claim information submitted through the counter-notice process may be disclosed to the Rights Holder.
Restoration of Content
Where the Copyright Act procedure applies, Famepify may restore removed Content or access where the statutory requirements for restoration have been satisfied.
Under the applicable Nigerian statutory framework, restoration may occur where a written counter-notice has been forwarded to the Rights Holder and the applicable statutory response period expires without the response required to prevent restoration.
No Guarantee of Restoration
Content shall not necessarily be restored where:
- infringement remains apparent;
- another valid legal basis requires continued removal;
- a court order applies;
- the Nigerian Copyright Commission directs otherwise;
- another law prohibits the Content;
- the Content separately violates the Acceptable Use Policy; or
- another legitimate ground supports continued restriction.
29Repeat Infringers
Repeat Copyright Infringement
Where Famepify is subject to the repeat-infringer provisions applicable to service providers under the Copyright Act, Famepify shall maintain and apply procedures required by those provisions.
This may include:
- issuing a warning after repeated infringement notifications;
- informing the affected subscriber of applicable consequences;
- permitting an applicable challenge based upon mistake or misidentification; and
- suspending an Account where the statutory threshold and conditions are satisfied.
Statutory Challenge
Where applicable law provides a period within which a subscriber may challenge a repeat-infringer warning, Famepify shall administer the challenge according to the statutory procedure.
Where the Copyright Act requires unresolved qualifying challenges to be referred to the Nigerian Copyright Commission, Famepify may make or facilitate that referral as required.
Independent Acceptable Use Enforcement
Nothing in the statutory repeat-infringer process prevents Famepify from taking separate action under the Acceptable Use Policy where the same conduct independently constitutes:
- fraud;
- malicious abuse;
- unlawful activity;
- security risk; or
- another material Policy violation.
30Re-Uploaded Infringing Content
Repeat Upload of Removed Content
Where applicable law requires Famepify to take effective measures against re-upload of Content removed pursuant to a valid statutory copyright process, Famepify may employ reasonable technical or manual measures for that purpose.
No General Monitoring Representation
Nothing in this section constitutes a representation that Famepify continuously monitors all Content or can guarantee detection of every re-upload.
31Misrepresentation in Copyright Notices
Good-Faith Notices Required
A person submitting a copyright notice or counter-notice shall do so in good faith.
A person shall not knowingly misrepresent:
- that material is infringing; or
- that material was removed or disabled by mistake or misidentification.
Potential Liability
Knowingly false statements in an infringement or counter-notice may expose the person making the statement to liability under applicable law.
Famepify may also take action under the Acceptable Use Policy where a notice process is intentionally abused.
32No Automatic Removal Based Solely on Allegation
Reasonable Assessment
Outside a statutory procedure requiring a specified response, Famepify is not required to accept every intellectual-property allegation as conclusively established merely because a notice has been received.
Famepify may consider:
- apparent ownership;
- licence information;
- authorisation;
- applicable exceptions;
- fair dealing;
- identity of the parties;
- location of the Content;
- available evidence;
- contractual arrangements; and
- applicable law.
33Protective Removal
Where there is a credible infringement claim and continued availability creates material legal risk, Famepify may temporarily remove or restrict Content while the matter is investigated.
Such temporary action shall not necessarily constitute an admission that the claimant’s legal position is correct.
34Trade Mark Complaints
Reporting Trade Mark Infringement
A Rights Holder who believes material available through Famepify unlawfully infringes or misuses a trade mark may submit a Trade Mark Complaint to:
- legal@famepify.com
- Phone / WhatsApp
- +2349061160205
- Address
- Wuse, Abuja, Nigeria
- Suggested Subject
- Trade Mark Infringement Complaint
Information to Include
A Trade Mark Complaint should include sufficient information to assess the claim.
Relevant information may include:
- claimant’s full name or business name;
- contact information;
- trade mark concerned;
- registration number, where registered;
- jurisdiction of registration;
- description of unregistered rights where applicable;
- goods or services protected;
- location of the complained-of use;
- explanation of why the use is allegedly unlawful;
- evidence of ownership or authority; and
- signature of the claimant or authorised representative.
Registration Not Always Required
Failure to provide a registration number shall not automatically invalidate a claim where applicable law recognises enforceable unregistered rights.
However, a claimant relying upon registered rights should provide sufficient registration information to facilitate verification.
35Trade Mark Use That May Be Lawful
Descriptive and Referential Use
Use of another person’s trade mark is not automatically unlawful merely because the mark appears on Famepify.
The assessment may distinguish between:
- source-identifying use;
- descriptive use;
- nominative reference;
- comparative reference;
- criticism;
- commentary;
- identification of compatibility;
- reporting; and
- deceptive use suggesting false affiliation.
Famepify shall not remove legitimate criticism merely because a protected brand name is mentioned.
36Passing Off and Brand Impersonation
Misrepresentation of Business Identity
A complaint may be considered where a person uses Famepify or material associated with Famepify to falsely represent that the person:
- operates Famepify;
- is officially authorised by Famepify;
- is a Famepify employee;
- owns Famepify;
- operates an official Famepify payment channel; or
- is otherwise commercially connected with Famepify when no such relationship exists.
Customer Confusion
Relevant factors may include whether the conduct is likely to mislead customers as to:
- source;
- ownership;
- sponsorship;
- affiliation;
- endorsement; or
- commercial responsibility.
37Copyright Claims Against Famepify Content
Claims Concerning Platform Content
A person who believes that Famepify itself has reproduced or otherwise used protected material without authorisation may submit a Copyright Infringement Notice under this Policy.
The notice shall receive substantive review and shall not be rejected merely because the Content was published by Famepify rather than by a User.
Correction and Removal
Where Famepify confirms that Platform Content infringes another person’s rights, appropriate action may include:
- removal;
- replacement;
- correction;
- attribution where legally sufficient and agreed;
- obtaining a licence;
- disabling access;
- modification; or
- another lawful remedy.
38Claims Involving Third-Party Suppliers
Supplier Content
Certain Content or materials associated with Services may originate from third-party suppliers.
Receipt of material from a supplier shall not automatically establish that the supplier owned every intellectual-property right required for its use.
Supplier Cooperation
Where an infringement complaint concerns supplier-originated Content, Famepify may:
- notify the supplier;
- request evidence of rights;
- obtain licence information;
- disable or remove the affected Content;
- suspend the relevant supplier Content; or
- take another reasonable action.
An upstream supplier’s assurance shall not automatically override reliable evidence of infringement.
39Claims Involving User-Submitted Links
Links to External Content
A User may submit URLs as part of an Order or other Platform function.
Submission of an external URL does not necessarily mean that Famepify hosts the underlying Content.
External Hosting
Where the allegedly infringing material exists only on a Third-Party Platform outside Famepify’s control, Famepify may be unable to remove the underlying material.
Famepify may, where appropriate:
- remove the link from its own system;
- cancel or restrict related use;
- notify the User;
- direct the Rights Holder to the hosting platform; or
- take another action within Famepify’s reasonable control.
40Search, Directories and Hyperlinks
Information Location Functions
Where Famepify provides links, references or other information-location functionality, intellectual-property complaints concerning linked external material shall be considered according to the nature of the link, Famepify’s knowledge, applicable law and Famepify’s control over the relevant material.
No Endorsement Through Linking
A hyperlink does not, by itself, constitute endorsement, ownership or authorship of the linked Content.
41Technological Protection Measures
Unauthorised Circumvention
A person shall not use Famepify to unlawfully circumvent a technological protection measure protecting copyrighted material.
Lawful Exceptions
This provision shall not prohibit circumvention or related activity expressly permitted by applicable law.
42Rights Management Information
Removal or Alteration
A person shall not knowingly falsify, remove or alter copyright-management or rights-management information in circumstances prohibited by applicable law.
Such information may include identifying information associated with:
- author;
- owner;
- work;
- licence; or
- terms governing use.
43Counterfeit and Unauthorised Materials
Counterfeit Content and Brand Assets
Famepify shall not knowingly facilitate commercial distribution of counterfeit materials or deceptive reproductions of protected Brand Assets in violation of applicable law.
No Assumption From Similarity Alone
Similarity does not automatically establish infringement.
Any claim shall be assessed according to the legal protection applicable to the work or mark and the circumstances of the disputed use.
44Fair Dealing and Copyright Exceptions
Statutory Exceptions Remain Preserved
Nothing in this Policy shall be interpreted as eliminating copyright exceptions recognised by applicable law.
Under Nigerian copyright law, fair dealing may apply to specified purposes subject to statutory conditions and relevant fairness factors.
Case-Specific Assessment
Whether a particular use qualifies for fair dealing depends upon the circumstances.
The mere statement “fair use” or “fair dealing” does not automatically establish legality.
Likewise, commercial use does not necessarily resolve every copyright question without examining the applicable law.
45Permissions and Licensing Requests
Requesting Permission
A person wishing to reproduce or use Famepify-owned material beyond what is permitted by law may request permission through:
- legal@famepify.com
- Phone / WhatsApp
- +2349061160205
- Address
- Wuse, Abuja, Nigeria
- Suggested Subject
- Intellectual Property Permission Request
Information to Include
A permission request should identify:
- material to be used;
- proposed use;
- medium;
- territory;
- duration;
- whether the use is commercial;
- proposed modifications; and
- applicant contact information.
No Permission Until Granted
Submission of a permission request does not itself grant permission.
Unless another legal basis exists, authorisation applies only when granted by a person authorised to provide it.
46Brand Permission
Use of Logos and Brand Materials
Use of Famepify logos or official Brand Assets in advertising, reseller websites, applications, merchandise or promotional materials may require express permission.
Where permission is given, Famepify may require compliance with brand guidelines concerning:
- colour;
- spacing;
- proportions;
- placement;
- wording;
- permitted context; and
- association claims.
Revocation
A voluntary brand licence may be revoked in accordance with its terms where the licensee:
- exceeds the permitted scope;
- falsely represents affiliation;
- damages brand integrity through deceptive use;
- violates applicable law; or
- otherwise materially breaches the licence.
47Media and Press Use
Editorial Reference
Journalists, reviewers and commentators may make lawful references to Famepify without requiring permission merely to identify the business.
Official Assets
Where official logos, screenshots, photographs or other Brand Assets are requested for publication, Famepify may make approved assets available subject to stated conditions.
48Screenshots of the Platform
Ordinary Referential Screenshots
Reasonable screenshots of publicly accessible Famepify interfaces may be used for legitimate:
- reporting;
- reviews;
- commentary;
- tutorials;
- criticism; or
- similar lawful purposes,
- subject to applicable copyright, privacy and confidentiality requirements.
Sensitive Information
A person publishing Platform screenshots remains responsible for avoiding unlawful disclosure of:
- another User’s personal information;
- Credentials;
- private support conversations;
- payment information;
- API secrets; or
- other confidential information.
49Confidential and Proprietary Information
Non-Public Information
Certain non-public Famepify information may be protected independently from copyright.
Such information may include:
- source code;
- security architecture;
- private supplier arrangements;
- internal pricing methodology;
- confidential technical documentation;
- unreleased product information;
- fraud-detection methods;
- proprietary business processes; and
- trade secrets.
No Licence Through Accidental Access
Accidental or unauthorised access to confidential Famepify information does not create a licence to publish or exploit that information.
Applicable whistleblowing, public-interest, legal-reporting and other mandatory rights remain unaffected.
50Intellectual Property and Privacy
Personal Data in IP Notices
An intellectual-property complaint may contain personal data, including:
- claimant name;
- contact information;
- signature;
- ownership information;
- representative information; and
- supporting evidence.
Such information shall be processed in accordance with the Privacy Policy.
Disclosure to Affected Parties
Where necessary to administer an infringement process, Famepify may disclose relevant notice or counter-notice information to:
- the affected User;
- the Rights Holder;
- service providers;
- legal advisers;
- regulators;
- the Nigerian Copyright Commission;
- courts; or
- other recipients where legally required.
Only information reasonably necessary for the applicable purpose should be disclosed.
51Intellectual Property Notices and Confidential Information
Notices May Be Shared
A complainant should not include information in an infringement notice that the complainant is not prepared to have disclosed where disclosure is reasonably necessary to process the claim.
Redaction
Famepify may redact:
- unrelated personal data;
- sensitive financial information;
- security information;
- privileged material; or
- other information not reasonably required by the recipient.
52Preservation of Evidence
IP Dispute Records
Famepify may preserve records relating to an intellectual-property dispute where reasonably necessary for:
- investigation;
- takedown administration;
- counter-notice handling;
- repeat-infringer procedures;
- regulatory proceedings;
- litigation;
- enforcement;
- fraud prevention; or
- defence of legal claims.
No Alteration of Evidence
A person participating in an IP dispute shall not knowingly falsify or materially alter evidence submitted through the procedure.
53Enforcement
Available Measures
Where Famepify reasonably determines that Content or conduct violates this Policy, Famepify may, subject to applicable law:
- request additional information;
- issue a warning;
- remove Content;
- disable access;
- remove a link;
- restrict a Platform function;
- cancel an affected Service;
- restrict an API key;
- suspend an Account;
- terminate an Account;
- preserve evidence;
- refer a matter to the Nigerian Copyright Commission;
- respond to a court order;
- notify an affected service provider;
- pursue civil remedies; or
- take another proportionate action.
Proportionality
Enforcement shall take account of:
- seriousness;
- apparent intent;
- repeated conduct;
- scale;
- rights affected;
- evidence;
- statutory requirements;
- security implications;
- whether the matter can be corrected; and
- other relevant circumstances.
Where law requires a specific action or timeframe, the statutory requirement shall prevail.
54Account Suspension
Intellectual Property Violations
A serious or repeated intellectual-property violation may result in Account restriction or suspension where permitted or required by law and the applicable Famepify Policies.
No Automatic Forfeiture of Funds
Suspension arising from an intellectual-property dispute does not, by itself, authorise confiscation of legitimate unused Customer-Funded Balance.
Any Wallet consequences shall be handled under the Billing, Wallet & Payment Policy and Refund Policy.
55Good-Faith Enforcement
Interim Action
Famepify may take temporary action where continued availability of disputed Content creates material infringement or legal risk.
No Admission
Temporary removal, suspension or restoration shall not necessarily constitute:
- admission of infringement;
- admission of non-infringement;
- admission of ownership;
- admission of liability; or
- final adjudication of the parties’ legal rights.
56Appeals and Disputes
Internal Review
A person affected by an intellectual-property enforcement decision may request review where there is a reasonable basis to believe that the decision resulted from:
- mistake;
- misidentification;
- incomplete information;
- licence;
- authorisation;
- applicable copyright exception;
- expired rights;
- incorrect ownership claim; or
- another material legal or factual issue.
Complaints Procedure
Formal disputes concerning Famepify’s handling of an intellectual-property matter may be submitted under the Complaints & Dispute Resolution Policy.
Nigerian Copyright Commission
Where applicable Nigerian copyright law permits or requires referral to the Nigerian Copyright Commission, the affected person may pursue that process.
Famepify’s internal procedures shall not prevent a person from exercising a regulatory or judicial remedy available under applicable law.
57Court Orders and Regulatory Directions
Compliance With Binding Orders
Famepify may remove, restrict, disclose or preserve Content where required by:
- a court of competent jurisdiction;
- the Nigerian Copyright Commission;
- another competent regulator; or
- another binding legal process.
Scope of Compliance
Famepify may assess the scope and validity of a legal request where permitted by law and shall not interpret a request as authorising disclosure or removal beyond what the applicable legal authority requires.
58Identification of Alleged Infringers
No Automatic Disclosure of User Identity
Receipt of an infringement allegation shall not automatically entitle the complainant to private information identifying a User.
Personal information shall be disclosed only where:
- required by applicable law;
- authorised by valid legal process;
- permitted under the Privacy Policy;
- necessary for administering an applicable statutory notice procedure; or
- otherwise lawfully justified.
Court-Ordered Identification
Where applicable copyright law permits a Rights Holder to seek a court order identifying an alleged infringer, Famepify shall respond to a valid order in accordance with law and available records.
59United States DMCA Notices
No Automatic Representation of DMCA Status
A complainant may submit a notice referring to the United States Digital Millennium Copyright Act where that law is considered relevant to the complainant’s claim.
Famepify may consider such a notice according to applicable law and available information.
Nothing in this Policy constitutes a representation that Famepify has registered a designated DMCA agent with the United States Copyright Office unless such designation is separately and expressly published.
Nigerian Procedure Remains Relevant
For Famepify’s Nigerian operations, the Copyright Act 2022 and other applicable Nigerian laws remain central to the copyright framework.
60Other Foreign Copyright Claims
Cross-Border Claims
Where a copyright claim arises under another jurisdiction’s law, Famepify may consider:
- territorial jurisdiction;
- location of the claimant;
- location of the alleged infringement;
- hosting location;
- applicable contractual law;
- international obligations; and
- binding legal process.
The existence of a foreign copyright claim does not automatically mean that every procedural requirement of that jurisdiction applies to Famepify.
61Intellectual Property Complaints Against Users
Notice to Affected User
Where appropriate and legally permitted, Famepify may notify a User that an intellectual-property complaint has been made concerning the User’s Content or conduct.
The notice may include sufficient information to enable the User to understand and respond to the claim.
Security and Privacy Exceptions
Famepify may limit disclosure where full disclosure would:
- create a genuine security risk;
- disclose protected personal data;
- violate a court order;
- interfere with a lawful investigation;
- reveal privileged information; or
- otherwise violate applicable law.
62Repeat Complaints and Abuse of Process
Repeated Valid Complaints
A Rights Holder may submit multiple legitimate infringement complaints where multiple infringements occur.
The mere fact that a person has made previous complaints shall not reduce the validity of a new legitimate claim.
Abusive Notice Practices
Famepify may restrict misuse of the IP reporting process involving:
- knowingly false claims;
- forged ownership records;
- fraudulent signatures;
- fabricated registrations;
- repeated complaints submitted solely to harass;
- attempts to remove legitimate criticism through false copyright claims;
- claims made on behalf of a Rights Holder without authority; or
- other intentional abuse.
Any restriction shall remain subject to the complainant’s statutory rights.
63Withdrawal of an Infringement Notice
Retraction
A Rights Holder who submitted an infringement notice may notify Famepify that the complaint has been withdrawn.
The withdrawal should identify:
- original complaint;
- affected Content;
- claimant; and
- scope of the withdrawal.
Effect of Withdrawal
Withdrawal of a complaint may support restoration of Content where appropriate.
Restoration shall not be required where the Content remains prohibited for another lawful reason.
64Settlement Between Parties
Private Resolution
A Rights Holder and affected User may resolve an intellectual-property dispute privately.
Where the parties reach agreement, they should provide Famepify with sufficient information to determine what Platform action remains necessary.
No Automatic Party to Settlement
Famepify does not become a party to a private settlement merely because the dispute concerns Content available through the Platform.
65No Legal Determination of Ownership
Famepify Is Not a Court
Except where Famepify is determining its own contractual or proprietary rights, Famepify’s internal handling of an infringement notice shall not constitute a final judicial determination of:
- copyright ownership;
- trade mark validity;
- infringement;
- damages;
- licence scope; or
- another disputed intellectual-property right.
Complex ownership disputes may require determination by:
- the Nigerian Copyright Commission;
- the Trade Marks Registry;
- a court;
- an arbitral tribunal where validly agreed; or
- another competent authority.
66Intellectual Property of Famepify Users
No Assignment to Famepify
Except where a separate agreement expressly provides otherwise, a User does not assign intellectual-property ownership to Famepify merely by:
- creating an Account;
- placing an Order;
- submitting a link;
- uploading a screenshot;
- submitting support material;
- making a Complaint; or
- otherwise using the Platform.
Operational Licence Only
Any licence arising from ordinary User submission shall be limited to what is reasonably necessary for the relevant Platform purpose unless the User expressly agrees to broader rights.
67Publicly Available Information
Public Availability Does Not Eliminate Copyright
The fact that material is publicly available on:
- Instagram;
- Facebook;
- TikTok;
- YouTube;
- X;
- LinkedIn;
- Telegram;
- a website; or
- another public platform
does not mean that the material is free of copyright.
Links and Identifiers
Use of a public username, profile URL or post URL for the purpose of fulfilling a social media growth Service does not, by itself, amount to a claim by Famepify that it owns the underlying Content.
68Service Descriptions and Catalogue Content
Famepify Descriptions
Original wording, organisation and presentation used in Famepify Service descriptions may be protected by copyright or other applicable rights.
Underlying Service Facts
Copyright protection does not create ownership over:
- ideas;
- facts;
- mere data;
- procedures;
- systems;
- concepts;
- methods of operation; or
- other subject matter excluded from copyright protection by applicable law.
Accordingly, Famepify’s rights in a description do not necessarily extend to every underlying factual statement or general idea contained within it.
69Copying Service Catalogues
Unauthorised Commercial Replication
Systematic copying of substantial Famepify catalogue Content for republication as a competing catalogue may violate Famepify’s contractual or intellectual-property rights depending upon the material copied and applicable law.
Reseller Integration
Authorised API or reseller access may permit use of certain Service information for legitimate resale purposes.
Such permission shall be governed by the API & Reseller Terms and does not create unrestricted ownership of Famepify’s proprietary catalogue or documentation.
70Enforcement of Famepify Rights
Protection of Famepify Intellectual Property
Where Famepify reasonably believes that its intellectual property is being infringed, Famepify may take lawful action including:
- contacting the alleged infringer;
- sending a cease-and-desist request;
- submitting a platform infringement report;
- submitting a statutory copyright notice;
- reporting fraudulent impersonation;
- filing a trade mark complaint;
- seeking injunctive relief;
- seeking damages;
- referring piracy to the Nigerian Copyright Commission; or
- pursuing another remedy available under law.
Proportionate Enforcement
Famepify should distinguish genuine infringement from:
- criticism;
- nominative use;
- fair dealing;
- independent creation;
- lawful comparison;
- parody;
- satire; and
- other lawful conduct.
Intellectual-property enforcement shall not be knowingly used to suppress lawful speech merely because it is unfavourable to Famepify.
71Limitation of Famepify's Role
User and Third-Party Content
Famepify does not warrant that every item of User Content or third-party material referenced through the Platform is free from intellectual-property claims.
Where Famepify receives credible notice of a potential infringement, it may investigate and take action according to this Policy and applicable law.
No General Duty to Pre-Clear All Rights
Nothing in this Policy constitutes a representation that Famepify performs advance copyright or trade mark clearance on every:
- User submission;
- external link;
- third-party profile;
- public social media post;
- supplier item; or
- external platform reference.
This limitation does not excuse Famepify from duties that arise once it has knowledge or notice in circumstances where applicable law requires action.
72Limitation of Liability for Good-Faith IP Action
Good-Faith Compliance
Where applicable law provides protection for good-faith action taken pursuant to a statutory notice-and-takedown procedure, Famepify may rely upon that protection to the extent its legal conditions are satisfied.
No Broader Exclusion Than Law Permits
Nothing in this Policy shall exclude liability for:
- fraud;
- wilful misconduct;
- knowing misrepresentation;
- infringement directly committed by Famepify where liability exists;
- breach of statutory duty;
- negligence where liability cannot lawfully be excluded; or
- another liability that applicable law does not permit Famepify to exclude.
73Relationship With the Acceptable Use Policy
Infringing Conduct
The Acceptable Use Policy prohibits knowing use of Famepify for unlawful intellectual-property infringement.
Conduct may therefore violate both:
- this Intellectual Property & Copyright Policy; and
- the Acceptable Use Policy.
Enforcement under one Policy does not prevent action under the other where independently justified.
74Relationship With the API & Reseller Terms
Developer and Reseller Rights
The API & Reseller Terms may grant limited rights to use:
- API documentation;
- Service information;
- product identifiers;
- approved Brand Assets; or
- other material
for authorised integration or resale.
Those permissions shall be interpreted according to their applicable scope and shall not constitute a general assignment of Famepify Intellectual Property Rights.
75Relationship With the Privacy Policy
Personal Data in IP Procedures
Personal information processed in connection with:
- copyright notices;
- counter-notices;
- trade mark complaints;
- ownership verification;
- enforcement;
- legal proceedings; or
- regulatory referrals
shall be processed in accordance with the Privacy Policy and applicable data-protection law.
76Relationship With the Complaints Policy
Disputing Famepify’s Handling
A person dissatisfied with Famepify’s internal handling of an intellectual-property matter may use the Complaints & Dispute Resolution Policy where appropriate.
This internal route does not prevent exercise of a regulatory or judicial remedy available under law.
77Changes to This Policy
Policy Amendments
Famepify may update this Policy to reflect:
- changes in copyright law;
- changes in trade mark law;
- Nigerian Copyright Commission guidance;
- changes to Platform functionality;
- changes to User Content features;
- new API functions;
- new reseller functionality;
- judicial decisions;
- international intellectual-property developments; or
- other legitimate legal or operational developments.
The Last Updated date shall identify the current version.
Existing Claims
A later Policy amendment shall not be used to retrospectively eliminate a right, defence or remedy that arose under applicable law before the amendment.
78Governing Law
Nigerian Law
This Policy shall be governed principally by the laws of the Federal Republic of Nigeria, including applicable copyright and trade mark laws.
Subject to any mandatory right that cannot lawfully be excluded, the courts located in Abuja, Nigeria shall have jurisdiction over any dispute arising out of or in connection with this Policy.
Nothing in this clause excludes mandatory rights arising under another jurisdiction where such law validly applies.
79Mandatory Law
Statutory Rights and Exceptions Prevail
Where this Policy conflicts with a mandatory intellectual-property rule, statutory exception, court order or regulatory requirement, the applicable law shall prevail to the extent of the conflict.
Nothing in this Policy shall be interpreted as:
- creating copyright where copyright does not subsist;
- converting ideas or mere data into copyrighted works;
- eliminating fair dealing;
- invalidating an existing licence;
- eliminating an author’s applicable moral rights;
- creating a registered trade mark where none exists;
- preventing lawful criticism;
- preventing lawful comparative reference;
- preventing regulatory complaints;
- preventing judicial proceedings; or
- excluding another right or defence that cannot lawfully be restricted.
80Severability
Invalid Provisions
If any provision of this Policy is held to be unlawful, invalid or unenforceable, the remaining provisions shall continue in effect to the fullest extent permitted by law.
Any affected provision shall be interpreted or modified only to the minimum extent necessary to preserve its lawful purpose.
81No Waiver
Failure to Enforce
Failure by Famepify to enforce an Intellectual Property Right in one instance shall not constitute permanent abandonment or waiver of that right.
Likewise, permission granted for one use shall not automatically authorise:
- another use;
- another person;
- another medium;
- another territory; or
- another period.

83Final Legal Effect
Balance Between Protection and Lawful Use
This Policy is intended to protect Famepify’s legitimate Intellectual Property Rights, respect the rights of third-party creators and Rights Holders, provide a structured process for addressing alleged infringement and preserve lawful use of protected material.
Famepify does not acquire ownership of User Content merely because the Content passes through the Platform.
Likewise, Users do not acquire ownership of Famepify Intellectual Property Rights merely because they use, purchase from, integrate with or resell Services provided through Famepify.
No Overreach Beyond Applicable Rights
Nothing in this Policy shall be interpreted as granting Famepify broader Intellectual Property Rights than Famepify actually owns, licenses or is otherwise legally entitled to enforce.
Where material belongs to a third party, that third party’s rights remain unaffected.
Where applicable law permits a use through fair dealing, licence, statutory exception, public-domain status or another lawful basis, this Policy shall not convert that lawful activity into infringement.
Preservation of Enforcement and Defence Rights
Nothing in this Policy shall be interpreted as:
- preventing Famepify from enforcing valid copyright or trade mark rights;
- preventing a Rights Holder from submitting a legitimate infringement notice;
- preventing an affected User from disputing a mistaken claim;
- preventing restoration where statutory conditions are satisfied;
- excusing knowing infringement;
- protecting knowingly false infringement notices;
- eliminating statutory copyright exceptions;
- eliminating moral rights that applicable law preserves;
- preventing referral to the Nigerian Copyright Commission;
- preventing enforcement of a valid court order;
- preventing a person from commencing lawful judicial proceedings; or
- restricting another Intellectual Property Right, defence or remedy that applicable law preserves.
The determination of any particular intellectual-property matter shall depend upon the protected work or mark, ownership, applicable licences, disputed use, available evidence, statutory exceptions, territorial law and the specific circumstances of the claim.
